1) Acceptance and eligibility

By accessing or using Finanzas Claro (the “Site”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree, do not use the Site. These Terms apply to visitors, readers, and any other person who accesses the Site.

You must be at least 16 years old to use the Site. If you are under 18, you represent that you have permission from a parent or legal guardian to use the Site and that your parent or guardian has reviewed these Terms. The Site is intended for a general audience and is not designed to solicit or knowingly collect information from children under 16.

2) Service description and scope

Finanzas Claro provides educational content related to financial literacy, with a focus on personal budgeting, spending awareness, and money habits. Content may include articles, guides, checklists, and FAQs. Examples may reference Chilean context and CLP amounts for clarity.

The Site does not provide individualized financial, legal, accounting, tax, or investment advice. Any content is for informational and educational purposes only, and you should not treat it as a substitute for professional advice tailored to your situation. You are responsible for your decisions and for verifying any information before acting on it.

We may update, reorganize, or remove content at any time. We may also introduce new educational sections, formats, or tools. We do not guarantee that any specific topic will remain available, or that content will be updated for every change in laws, prices, or third party services.

3) User obligations and acceptable use

You agree to use the Site in a lawful manner and in a way that does not interfere with the normal operation, security, or availability of the Site. You are responsible for ensuring that your access to the Site complies with applicable laws and regulations.

If the Site offers optional features such as contact forms, you agree to provide accurate information and to keep your communications respectful. You also agree not to submit sensitive personal data through free text fields. For example, do not send full card numbers, bank credentials, national identification numbers, or other high risk information.

If any account features are introduced in the future, you agree that you will maintain the confidentiality of your access credentials, you will not share an account with others, and you will not create more than one account per person unless we explicitly allow it.

The Site and its content, including text, graphics, logos, design elements, and code, are owned by or licensed to Finanzas Claro SpA and are protected by intellectual property laws. “Finanzas Claro” and our logo are trademarks or trade dress of the company.

Subject to these Terms, we grant you a limited, non exclusive, non transferable, revocable license to access and use the Site for your personal, non commercial educational use. You may share links to our pages and quote short excerpts for commentary or educational purposes, provided you include attribution and do not present the excerpt as your own work.

You may not copy, reproduce, distribute, publicly display, create derivative works from, or exploit any portion of the Site for commercial purposes without our prior written permission. This includes republishing full articles, scraping our content into a database, or using the Site’s design and code to create a confusingly similar product.

5) Prohibited activities

You agree not to engage in any activity that could harm the Site, our users, or our operations. Prohibited activities include:

• Attempting to gain unauthorized access to the Site, server, hosting environment, or related systems.
• Probing, scanning, or testing the vulnerability of the Site or bypassing security measures.
• Scraping, harvesting, or extracting content or data from the Site using automated means without permission.

We may investigate suspected violations and may cooperate with law enforcement, regulators, or other authorities when we believe it is necessary to protect our users, the public, or our legal interests.

6) Disclaimer of warranties

The Site and all content are provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, we disclaim all warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non infringement.

We do not warrant that the Site will be uninterrupted, error free, or secure. We also do not warrant that any content is complete, current, or applicable to your circumstances. Educational examples can become outdated due to changes in prices, regulations, or third party services.

Any reliance you place on content is at your own risk. You are solely responsible for evaluating the usefulness of information and for applying it appropriately, including verifying numbers, dates, and assumptions used in budgeting exercises.

7) Limitation of liability

To the maximum extent permitted by applicable law, Finanzas Claro SpA and its directors, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, business interruption, or reputational harm, arising out of or related to your use of (or inability to use) the Site.

To the maximum extent permitted by applicable law, our total liability for direct damages arising out of or related to the Site will be limited to the amount you paid to us for use of the Site in the twelve months preceding the event giving rise to the claim, or EUR 100 (one hundred euros), whichever is lower. For clarity, the Site is currently offered as an educational resource without paid access.

Some jurisdictions do not allow certain limitations of liability. If those laws apply to you, some of the above limitations may not apply, and our liability will be limited to the fullest extent permitted by law.

8) Indemnification

You agree to indemnify, defend, and hold harmless Finanzas Claro SpA and its directors, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Site, (b) your breach of these Terms, (c) your violation of any law or regulation, or (d) your infringement of any third party rights.

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate with our defense and not to settle the matter without our prior written consent.

9) Third party links and resources

The Site may reference third party websites or resources for general background reading. Third party links are provided for convenience only. We do not control third party sites and are not responsible for their content, security, availability, or privacy practices.

Your interactions with third parties are solely between you and the third party. If you choose to visit a third party site, review its terms and privacy policy before providing information or relying on its content.

11) Governing law and jurisdiction

These Terms and any dispute arising out of or related to them, the Site, or our content will be governed by the laws of the Republic of Chile, without regard to conflict of law principles.

Subject to the Dispute Resolution section below, you agree that the competent courts located in Santiago, Región Metropolitana, Chile will have exclusive jurisdiction to resolve disputes related to these Terms or the Site.

12) Dispute resolution

Before filing a formal claim, you agree to attempt to resolve the dispute informally by contacting us and providing a brief written description of the issue and the relief you seek. We will make a good faith effort to respond and, if possible, resolve the dispute.

The informal resolution period is 30 days from the date we receive your notice. If we cannot resolve the dispute within that period, either party may pursue a claim in the courts identified in the Governing Law and Jurisdiction section, unless applicable law provides otherwise.

13) Termination and suspension

We may suspend or terminate your access to the Site at any time, with or without notice, if we reasonably believe you have violated these Terms, are creating risk for other users, or are attempting to interfere with the Site’s security or operation.

If access is terminated, the following sections will survive termination: Intellectual Property, Prohibited Activities, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law and Jurisdiction, Dispute Resolution, and any other provisions that by their nature should survive.

14) Modifications to these Terms

We may modify these Terms from time to time to reflect changes to the Site, legal requirements, or our operating practices. Unless a change is required to take effect sooner for legal or security reasons, updated Terms will become effective 14 days after they are posted on this page.

Your continued use of the Site after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, your remedy is to stop using the Site.
